Terms and Conditions

The General Terms and Conditions of the Kaleido ecoOffice online store have been compiled in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).

The Kaleido ecoOffice online store (hereinafter also "store") is operated by the company Pinocchio d.o.o., registration number: 5706572, tax number: SI43664318, which is also a provider of e-commerce services (hereinafter also the "seller" or "Kaleido ecoOffice"). Pinocchio d.o.o. is liable for VAT.

The data were entered in the Business Register of Slovenia on 20 January 1993 under the entry number 1-5113-00.

The General Terms and Conditions determine the operation of the Kaleido ecoOffice online store, the rights and obligations of the user and the store and regulate the business relationship between Kaleido ecoOffice and the customer.

The buyer is bound by the general conditions that are valid at the time of purchase (placing an online order). When placing an order, the user is reminded of the general terms and conditions of business and confirms his/her acquaintance with the latter by placing an order.

Types of users

With a one-time registration in the Kaleido ecoOffice online store via e-mail, the visitor becomes a guest of Kaleido ecoOffice, and with a confirmed registration in the Kaleido ecoOffice online store he/she becomes a member of Kaleido ecoOffice. Both the guest and the member of Kaleido ecoOffice (hereinafter also the "user") acquire the right to purchase in the online store Kaleido ecoOffice.

Upon registration in the Kaleido ecoOffice online store, the visitor obtains a username that is the same as his/her e-mail address, and a password. The username and password of the kaleidoshop.si member are unambiguously determined and linked to the entered data.

Registration is also possible during the purchase process.

If the user wishes to change his/her e-mail address at any time later, he/she needs to send a request via the contact form. The change of e-mail address will be made on the same or the next working day at the latest, and the user will be notified by e-mail.

Availability of information

Kaleido ecoOffice undertakes to provide the buyer with the following information before he/she is bound by the contract or offer:

  1. data on the company Kaleido ecoOffice (name and registered office of the company, registration number);
  2. contact details that enable the user to communicate quickly and efficiently (contact form);
  3. essential characteristics of the items (including after-sales services and warranties) and the period of validity of this information;
  4. availability of items (each item offered on the website should be available within a reasonable time);
  5. conditions of delivery of items (and method, place and deadline of delivery);
  6. prices, which must be clearly and unambiguously set and must show clearly whether they already include taxes and transport costs and other charges, as well as the period of validity of this information;
  7. method of payment and delivery or completion, and the period of validity of this information;
  8. time validity of the offer;
  9. period within which it is possible to withdraw from the contract and the conditions for withdrawal (description of the right of withdrawal in accordance with Article 43c of the ZVPot; in cases where the consumer does not have the right of withdrawal in accordance with Article 43.č ZVPot he/she must be fully informed on the matter);
  10. explanation of the complaint procedure, including all details of the contact person or customer service.

Offer of articles

Due to the nature of online business, the offer of Kaleido ecoOffice is updated and changed regularly.

Order

The purchase contract between kaleidoshop.si and the customer is concluded in the Kaleido ecoOffice online store at the moment when Kaleido ecoOffice sends the customer the first electronic message about the status of his/her order (with the title: Order Accepted). From this moment on, all prices and other conditions are fixed and apply to both Kaleido ecoOffice and the buyer.

The sales contract (i.e. the first electronic message about the status of the order) is stored in electronic form on the Kaleido ecoOffice server.

Description of technical procedures for concluding the contract

When you find the right product, use the ADD TO CART button to add it to the cart. You can add multiple products to the cart at the same time. Once you have selected all the relevant products, click on the button IN THE CART in the upper right corner of the screen next to the search engine. Before placing an order, you can review and correct the entire selection, including quantity and price, and select the type of delivery. When you are finished, click the NEXT STEP button where you can enter your details, notes and select the payment, and if desired, change the delivery type again. Click the BUY NOW button to place your order. You will receive a summary of the order to the email address you entered in the entered data, which you need to save. We also have saved this contract, which you can obtain by requesting it via the contact form.

Before placing an order, you can review and correct the entire selection, including quantity and price, by clicking on the IN THE CART button described above.

Methods of payment

Kaleido ecoOffice enables the following payment methods:

Credit card, proforma invoice, PayPal.

Issuance of invoice

After delivery of the ordered items, Kaleido ecoOffice sends the invoice to the customer's e-mail address.

The invoice includes a breakdown of the price and all costs related to the purchase, as well as a notice of the right to withdraw from the contract and return the goods.

The buyer is obliged to check the correctness of the data before placing the order. Subsequent objections regarding the correctness of the issued invoices are not taken into account.

Prices

Prices are the same for all Kaleido ecoOffice users. You become a user of the Kaleido ecoOffice online store by registering in the online store as a member of Kaleido ecoOffice or by registering once in the online store as a guest of Kaleido ecoOffice.

All prices include VAT, unless explicitly stated otherwise.

Prices are valid at the time of placing the order and do not have a predetermined validity.

Prices are valid in case of payment with the above payment methods, under the above conditions.

Purchase notification process

  1. Kaleido ecoOffice order

After placing the order, the buyer receives a notification by e-mail that the order has been accepted. Kaleido ecoOffice reviews the order, checks the availability of the ordered items, and confirms the order or rejects it with a specified reason. Kaleido ecoOffice may call the customer on his/her contact telephone number to verify the data or to ensure the accuracy of the delivery. When delivering items that Kaleido ecoOffice does not have in stock in its own warehouse, Kaleido ecoOffice is exclusively bound to the delivery by its supplier and to the time in which this supplier can deliver the item to Kaleido ecoOffice. Kaleido ecoOffice informs the customer via e-mail about up-to-date information regarding the delivery of items. If the delivery period is very long and the buyer does not want to wait, the buyer can notify Kaleido ecoOffice which will remove the item from the order and return to the buyer any funds already paid, and either deliver other items from the order or cancel the entire order, at the choice of the buyer.

If the supplier of Kaleido ecoOffice does not confirm the availability of the ordered items no later than three months from the date of placing the order, Kaleido ecoOffice may reject the customer's order on the grounds that the item is not available. The customer's order expires on the day of rejection.

  1. The order has been shipped/The order is ready for collection

Kaleido ecoOffice prepares and sends the item within the agreed deadline and notifies the customer by e-mail.

In the event that the buyer decides to cancel the order in time, he/she must immediately notify the seller via the contact form. If the order has already been shipped, the buyer needs to reject the shipment to the delivery service.

Purchase for legal entities

The purchase process for legal entities is exactly the same as for natural persons, except that you place an order as a natural person and add “I want an invoice to the company” and information about the company in the note.

If you want an invoice to the company, you need to accept the terms and conditions that apply to companies. The main difference is in the possibilities of withdrawing from the contract: we enable companies, sole proprietors and other legal entities to return the delivered items within the warranty conditions. The listed legal entities do not have the option to withdraw from the contract within 14 days of receiving the item without a specified reason as is the case for consumers (natural persons).

Purchases of legal entities are also subject to the General Terms and Conditions of kaleidoshop.si, apart from the previously mentioned possibility of withdrawal from the contract.

The Kaleido ecoOffice online store provides legal entities with the following methods of payment:

  • By bank transfer to the account of the manager of Kaleido ecoOffice or by offer/proforma invoice.

Right of withdrawal of the consumer from the contract

In the case of distance financial services contracts, the consumer has the right to inform the company within 14 days that he/she is withdrawing from the contract without having to give a reason for his decision or pay a contractual penalty. The communication shall be deemed to be timely if it is sent within the time limit set for withdrawal from the contract.

If the consumer has already received the amount or goods and withdraws from the contract, he/she must immediately, or no later than 14 days from the submission of the message referred to in the first paragraph of the previous article, return the amount or goods to the company.

Reimbursement of payments must be made by the company immediately, but no later than 14 days after receipt of the notice of withdrawal from the contract, except for the amount referred to in the previous paragraph.

The consumer (this applies only to natural persons who acquire the item for purposes outside their gainful activity) has the right to notify the seller within 14 days of receipt of the items that he/she withdraws from the contract without having to give a reason for his/her decision. The deadline starts one day after the date of receipt of the items.

The consumer may use this RETURN FORM to withdraw from the contract

The consumer (this applies only to natural persons who acquire the item for purposes outside their gainful activity) has the right to notify the seller within 14 days of receipt of the items that he/she withdraws from the contract without having to give a reason for his/her decision. The deadline starts one day after the date of receipt of the items.

Withdrawal from the contract is notified by the consumer via the contact form.

In case of withdrawal from the contract, the consumer returns the received item by mail to the seller's address: Pinocchio d.o.o., Gosposka ulica 1, 3000 Celje.

The return of the received items to the company within the deadline for withdrawal from the contract is considered a notice of withdrawal from the contract.

The consumer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased without the consumer's fault.

The only cost borne by the consumer in connection with the withdrawal from the contract is the cost of returning the items (which in the case of shipping is charged according to the price list of the delivery service and depends on whether it is a shipment/package/cargo). The item must be returned to the seller no later than 14 days from the notification of withdrawal from the contract (purchase).

The consumer shall not be entitled to withdraw from contracts for contracts which have as their object a product which has been manufactured to the consumer's exact instructions and which has been adapted to his/her personal needs and which, by its nature, is not eligible for a refund, e.g., which is quickly perishable or the best before period of which already passed. There is no possibility of withdrawal from the contract when purchasing software or audio and video media if the consumer has opened the security seal.

Refunds will be made as soon as possible and no later than within 14 days of receipt of the returned item. In order to ensure the certainty, accuracy and timeliness of the return and to provide records of payments, the refund of the payment to the buyer is made in the form of the same means of payment as used in the purchase.

In exceptional cases, when the items are not returned in accordance with the ZVPot, we can offer the consumer the purchase of the item with the appropriate compensation, which is determined by the minutes upon return. Discounted purchase is taken into account upon confirmation by the consumer by e-mail. The consumer uses the said redemption only when ordering another item of the same or higher value.

The right to a refund of the purchase price in the event of a warranty claim and material defects is regulated in more detail by the provisions of the Consumer Protection Act (unofficial consolidated text).

Important instructions for returning items:

  • When returning items to the seller (Pinocchio d.o.o.), you must enclose the withdrawal form required via the contact form. Also attach a copy of the invoice.
  • The address for forwarding (sending) items to the seller is Pinocchio d.o.o., Gosposka 1, 3000 Celje.
  • We recommend that you use a delivery service that allows you to track the shipment and that the items are properly prepared for transport (you can use the original packaging or other appropriate safe packaging).
  • Shipping costs are always borne by the sender, unless otherwise agreed in advance. We do not accept redemption shipments.

Return of the item for legal entities

If you want a company account, you accept the terms and conditions that apply to companies. The main difference is in the possibilities of withdrawal from the contract: We enable companies, sole proprietors and other legal entities to return shipments of items under the warranty conditions. The organizations listed above do not have the option to withdraw from the contract within 14 days of receiving the item, without having to state the reason for their decision as is the case for consumers (individuals). Unfortunately, a refund is not possible. Purchases of legal entities are also subject to the General Terms and Conditions of Kaleido ecoOffice, with the difference in the previously mentioned possibilities of withdrawing from the contract.

Withdrawal of the consumer from the contract for the items from the set

If the consumer decides to withdraw from the contract for one of the items that made up a set, he/she can request a refund. The consumer can return one or more items from the set. Upon withdrawal from the contract for the item from the set, the consumer receives a refund on his/her current account in the amount of the funds paid for the item in question which he/she needs to return.

Warranty

Items have a warranty if stated on the warranty certificate or invoice. The warranty is valid subject to the instructions on the warranty certificate and upon submission of the invoice. Warranty periods are stated on the warranty certificates or on the invoice. You can request the form for returning the item in the warranty period via the contact form if the item has a warranty period written in the description.

Warranty information is also provided on the product presentation page. If there is no warranty information, the item does not have a warranty, or the information is not known at that time. In the latter case, the customer can contact Kaleido ecoOffice which will provide up-to-date information.

The warranty certificate is valid even if it is not signed or stamped.

Real fault

When is the defect material? When:

    • item does not have the properties necessary for its normal use or for marketing;
    • item does not have the properties necessary for the special use for which the buyer is buying it, but which was known to the seller or should have been known to him/her;
    • item does not have properties and qualities that have been explicitly or tacitly agreed or prescribed;
    • seller has delivered an item that does not match the pattern or model, unless the pattern or model was shown only for the purpose of notification.

Material defects are very rare in practice. If you believe that the purchased products did not have the properties necessary for their normal use or marketing, and in other cases which are defined as material errors by the Consumer Protection Act, and let us know correctly and no later than two months from the day the fault was discovered, you can request us to:

    • rectify a material defect in the product free of charge, or
    • return part of the amount paid in proportion to the material error, or
    • replace the defective product with a new defective product, or
    • refund the full amount paid.

Deliver the product to us for inspection. Please attach the return form to the product (request it via the contact form) so that the process will run faster. In case of a complaint for the purchased product, the buyer returns the product at his/her own expense to the seller. When sending the product to our address, please note that the shipping costs are always borne by the sender, unless otherwise agreed in advance. We do not accept redemption shipments.

  • In cases where the reported defect is not disputed, the request is granted within eight days of receiving the product for inspection. Otherwise, we will inform you in writing within eight days after receiving the product at the registered office of Pinocchio d.o.o., Gosposka 1, 3000 Celje, that the defect is disputed.

How is the suitability of an item checked?

It is checked with another, faultless item of the same type, as well as with the manufacturer's statements or statements on the item itself.

How is a material defect asserted?

The buyer must inform us of any material defect, together with a detailed description of it, at his/her own expense and within the statutory period, and at the same time allow us to inspect the item. The form for reporting a material defect can be found on the RETURN FORM.

The right to claim a material defect for an item is regulated in more detail by the provisions of the Consumer Protection Act.

We are liable for material defects on new products for 2 years from the delivery of the product.

 

 

Delivery

The contractual partners for the delivery of shipments from the seller Kaleido ecoOffice are GLS, DPD and DHL, but Kaleido ecoOffice reserves the right to choose another delivery service if it will be able to fulfill the order more efficiently.

The GLS service is used to send shipments in Slovenia. Full tracking and all information available at https://gls-group.eu/SI/sl/home

The DPD service is used to send shipments to the territory of EU Member States. Full tracking and all information available at https://www.dpd.com

The DHL Express service is used to send shipments to non-EU European countries and other countries around the world. Full tracking and all information available at http://www.dhl.com/en.html

The estimated delivery time is for information purposes only (not guaranteed) and may vary from country to country and also depends on the distance to the country of destination, road connections and local post quality standards.

The estimated time of delivery does not include the day on which the consignment was dispatched, Saturdays, Sundays, holidays and the time of the consignment passing through customs procedures.

If the customer believes that the package is lost or late, he/she can contact Kaleido ecoOffice  via the contact form.

Kaleido ecoOffice will make a request for inquiry only 30 days after the date of dispatch of the customer's order. Inquiries are no longer possible 6 months after the date of shipment.

Shipping cost is automatically calculated by our online calculator and depends on the weight and dimensions of the shipment.

Shipping costs can be calculated before ordering, as the cost will be added to the price of the product before order confirmation. Shipping costs also depend on the place of delivery, so they cannot be determined before you provide us with the required information about the place of shipment.

Shipping costs are not included in the price of the product.

Customs duties are not included in the total value of the order and are paid by the buyer at the place of destination. The payment process is managed by a third party (usually the carrier) and Kaleido ecoOffice is not responsible for the costs incurred.

We are sorry, but we are unable to reimburse you for shipping costs due to weather delays.

Kaleido ecoOffice does not take responsibility for delays in the arrival of packages shipped to rural areas.

Kaleido ecoOffice does not take responsibility for delays in the arrival of packages due to airport closures or flight delays.

Kaleido ecoOffice sends ordered products all over the world. International orders may require some form of identification before processing. If our online store system does not offer shipping to your country or region where you reside, please send us a message via the contact form so we can verify and possibly add your country or region to our system. If we may not be able to process your order, we will cancel it and refund your payment if the order has already been placed.

Our partner delivers packages to the address entered when placing the order.

You can also choose to deliver to any other name or address. For example, to your place of work. If delivery to a business address is selected, the chosen delivery service will deliver the package to the person authorized to pick up shipments at the company.

If you are not at the intended place at the time of delivery (company, office, hospital, dormitory, etc.), the courier will leave a message with further instructions.

Delivery times

We will inform you via e-mail about possible longer delivery times. In case the longer delivery time does not suit you, you can let us know and we will remove the item from the order or replace it with another one.

Due to the different availability of products, the order can be divided into several shipments. We can ship them in part or all at once.

In case of partial delivery, we will send you the items that are in stock immediately, and the rest when they become available.

If the products are not available 10 days after the deadline stated next to the product, you can let us know that you do not want to wait any longer and we will remove the product from the order and refund any funds already paid.

For items marked as "Delivery time is not known", we do not have information on how fast we can deliver them.

If you will be absent for a few days, you can inform us via the contact form of the desired delivery date. This means that your package will not be sent to the specified address before this date.

When we ship the shipment, we will send you a notification that we have already sent the items to you.

Personal data protection

Kaleido ecoOffice undertakes to permanently protect all personal data of the user in accordance with ZVOP-1.

Kaleido ecoOffice keeps the following data of Kaleido ecoOffice members for an indefinite period of time: name and surname, e-mail address, contact telephone number, primary address and delivery addresses, country of residence, time and date of registration and archive of communication with Kaleido ecoOffice.

Kaleido ecoOffice uses the stated personal data exclusively for the purposes of fulfilling the order (sending information material, offers, invoices) and other necessary communication with the member.

Under no circumstances will the user's data be passed on to unauthorized persons.

Kaleido ecoOffice keeps the following data of Kaleido ecoOffice guests only for the time until the order is fulfilled: name and surname, e-mail address, contact phone, primary address and delivery addresses, country of residence, time and date of registration and archive of communication with Kaleido ecoOffice. After the order has been filled in, only the data related to the individual order are stored, which can only be accessed by knowing the account number and the order number.

The user is also responsible for the protection of his/her personal data by ensuring the security of his/her e-mail address, username and password and by using the appropriate software (anti-virus) protection of his computer.

Company copyright

All content published on Kaleido ecoOffice online store is the property of Pinocchio d. o. o. and may only be used for non-commercial purposes. It may not be copied, reproduced or distributed in any other way without the permission of Pinocchio d.o.o.

Documents, information, data, ideas, concepts, visualizations and proposals published on kaleido.si and kaleidoshop.si are the exclusive property of Pinocchio d.o.o. The recipient is prohibited to use or provide and pass for free or free of charge to third parties any information contained on kaleido.si by himself or through related parties, without the prior written consent of Pinocchio d.o.o. or without a previously concluded written contract with the company Pinocchio d.o.o.

Kaleido ecoOffice reserves the right to change the content published on the kaleido.si and Kaleido ecoOffice websites.

Personalized products and copyrights

The Kaleido ecoOffice online store enables the creating of personalized products.

I, the contracting authority of a personalized product, declare that I am the author or copyright holder of the designs or photographs contained in the personalized product.

As the copyright holder, I agree that Kaleido ecoOffice uses the above-mentioned copyright work for the purposes of promotion and at the same time I allow it to be communicated to the public in various forms (e.g. publication on a website, television, etc.). For this purpose, I transfer the material copyrights on the said copyright work exclusively and without restrictions in time and place to Kaleido ecoOffice, namely the right of reproduction, the right of distribution, the right of processing (in agreement with the author), the right of public communication (the right of public performance, public transmission, the right of public broadcasting with phonograms and videograms, the right of public display, the right of broadcasting, the right of broadcasting retransmission, the right of secondary broadcasting, the right of making available to the public).

To the extent that the above copyright work contains the copyright works of other copyright and related rights holders, I declare that for the purpose of publishing the above photo I have either acquired copyright to use this work online or used the copyright works in accordance with the purpose of illustration, confrontation or reference. I take full responsibility for any damages and other claims of these copyright holders against Kaleido ecoOffice due to the publication of my above-mentioned copyright work online.

When ordering a personalized product, the client can, after payment, transfer a template on which he/she will upload his/her design or photo for the implementation of a personalized product. The client does not become the owner of the template.

Communication

Kaleido ecoOffice will contact the user via means of distance communication only if the user does not explicitly object to this, and in accordance with the provisions of ZEKom-1.

Advertising e-mails of Kaleido ecoOffice will contain the following components:

  • They will be clearly and unambiguously marked as advertising messages;
  • The sender of Kaleido ecoOffice will be clearly visible;
  • Various campaigns, promotions and other marketing techniques will be marked as such. The conditions for participation in them will also be clearly defined;
  • The method of unsubscribing from receiving advertising messages will be clearly presented;
  • Kaleido ecoOffice will explicitly respect the user's wish not to receive advertising messages;
  • Kaleido ecoOffice advertising messages will be clearly visible and clearly separated from games and competitions.

Ratings, opinions and recommendations

The opinions, ratings and recommendations that customers write are part of the functionality of the online store and are intended for the community of all users.

Kaleido ecoOffice enables the opinion to be written by any user of the online store, and before the final publication, Kaleido ecoOffice reviews them. Kaleido ecoOffice will not publish opinions or contributions that are in any way offensive, inappropriate or which, in the opinion of kaleidoshop.si, do not offer benefits to other users and visitors.

By submitting an opinion or comment, the user expressly agrees to the terms of use of his/her opinion or comment and Kaleido ecoOffice allows the publication of part or all of the text in all electronic and other media. Kaleido ecoOffice has the right to use the content of the opinion or comment indefinitely and for any purpose that is in the business interest of Kaleido ecoOffice, including publication in advertisements or other marketing communications. At the same time, the author of the opinion declares and guarantees that he/she is the owner of the material and moral copyrights for the written opinions and comments, and that he/she transfers these rights non-exclusively and indefinitely to Kaleido ecoOffice.
